CHAPTER XII. PUBLIC PROPERTYCHAPTER XII. PUBLIC PROPERTY\ARTICLE 3. USE AND EXCAVATION OF THE PUBLIC RIGHT-OF-WAY

(a)   All openings made in the public streets or alleys to install, repair, or maintain utility service lines must be made as carefully as possible and all materials excavated from the trenches shall be removed or placed where the least inconvenience to the public will be caused.

(b)   All openings shall be marked with sufficient barriers.  Beacons or Flashers shall be maintained around the opening at night and all other precautions shall be taken by the excavator to protect the public from damage to person or property.

(c)   Upon completion of the installation, repair, or maintenance that requires the opening of a street or alley, the responsible party shall refill the opening in a manner that will allow temporary use of the street or alley and shall immediately notify the City Clerk’s office that the street or alley is ready for final closure. If conditions exist that prohibit the ability of the responsible party to make the street or alley temporarily passable, then the responsible party shall leave sufficient barriers, beacons and/or flashers to make the area safe until final closure by the City can be completed.

(a)   The following fees shall be charged to the party responsible for the opening of an alley:

Note: When opening is over 48” in depth and is over 50’ in length a base fee of $100.00 shall apply and each additional foot shall be charged at $2.00 per foot.

(b)   The following fees shall be charged to the party responsible for the opening of a street:

Street openings shall be charged at a rate of $200.00 regardless of length, width, or depth.

(c)   These fees will be calculated by the City and will be charged by invoice to the responsible party.
