A CHARTER ORDINANCE EXEMPTING THE CITY OF MARION, KANSAS FROM SECTION 14-201, K.S.A. AS AMENDED, PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT, RELATING TO ELECTION OF THE MAYOR AND COUNCILMEN AND THEIR TERMS OF OFFICE.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MARION, KANSAS:
SECTION 1. The City of Marion, Kansas by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to it Section 14-201, K.S.A. as amended and provide substitute and additional provisions as hereinafter set forth in this Ordinance. Such statutory section is applicable to this City, but is not applicable uniformly to all cities.
SECTION 2. PREAMBLE: The City of Marion, Kansas, pursuant to its Constitutional home rule powers does hereby expand its governing body from a three member city commission represented by a Mayor, Commissioner of Finance and Revenue, and Commissioner of Streets and Public Utilities, to a five member city council represented by a Mayor and four Councilpersons elected by the City at large.
SECTION 3. On the first Tuesday in April, 2006, there shall be elected four Councilpersons from the City at large. The two Councilpersons receiving the highest and second highest vote totals at the election shall serve a 4 year term. The two Councilpersons receiving the third highest and fourth highest vote totals at the election shall serve a 2 year term
SECTION 4. On the first Tuesday in April, 2007, there shall be elected a Mayor from the City at large. He or She shall serve until the first Tuesday in April, 2010.
SECTION 5. On the first Tuesday in April, 2008, and each four years thereafter, there shall be elected two Council persons from the City at large. Each shall serve a 4 year term.
SECTION 6. On the first Tuesday in April, 2010, and each four years thereafter, there shall be elected a Mayor and two Council persons from the City at large. Each shall serve a four year term.
SECTION 7. All Council persons and the Mayor shall be a voting member of the governing body.
