A CHARTER ORDINANCE EXEMPTING THE CITY OF MARION, KANSAS, FROM THE PROVISIONS OF K.S.A.SUPP. 12-1222 AS THE SAME RELATES TO THE NUMBER OF MEMBERS ON THE CITY LIBRARY BOARD; PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT; AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MARION, K.ANSAS:

SECTION 1. The City of Marion, Kansas by the power vested in it by Article 12, Section 6, of the Constitution of the State of Kansas, hereby elects to and does exempt itself from and makes inapplicable to it, the provisions of K.S.A. Supp. 12-1222 requiring that in the case of a city library board seven (7) members shall be appointed; such statutory section is applicable to this city but is not uniformly applicable to all cities.

SECTION 2. The Mayor of Marion, with approval of the City Council, shall appoint a library board of seven (7) members.

SECTION 3. The membership of the City of Marion Library Board shall consist of seven (7) members. Of the (7) seven members, (2) two of the required (7) seven may be members who live within a (4) four mile radius from the city limits.
