A CHARTER ORDINANCE EXEMPTING THE CITY OF MARION, KANSAS, FROM K.S.A. 79-5001 TO 79-5018, INCLUSIVE, AS AMENDED, AND EXEMPTING THE AIRPORT FUND AND LIBRARY FUND OF THE CITY OF MARION FROM K.S.A. 79- 1952 AND PROVIDING SUBSTITUTE PROVISIONS ON THE SAME SUBJECT, AND REPEALING THE CITY OF MARION CHARTER ORDINANCE NO. 1.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MARION, KANSAS:

Section 1. The City of Marion, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt itself from and make inapplicable to it K.S.A. 79-5001 to 79-5018, inclusive, as amended, which provisions are commonly known as the “Aggregate Tax Levy Limitations” law and further, said City elects to exempt itself from and make inapplicable to it in regards to the airport fund and library fund K.S.A. 79-1952. All of said statutes hereinbefore referred to are not applicable uniformly to all cities of the same class.

Section 2. That Charter Ordinance No. 1 of the City of Marion, Marion, Kansas is hereby repealed for the fiscal years beginning after December 31, 1983.

Section 3. That the City of Marion is hereby authorized to levy taxes for the purpose of paying the cost of acquisition and maintenance of an airport and that said levy shall not exceed 3.00 mills.
